Anti-Spam Policy

Cupisweb Technology LTD (RC No. 8209413) maintains a strict zero-tolerance policy against spam and unsolicited electronic communications of any kind. This policy applies to all customers, resellers, and users of our hosting, email, and domain services.

Spam is not only a violation of our policies — it is harmful to recipients, damages server reputation, and in many jurisdictions is illegal. We take all spam complaints seriously and act on them promptly.

1. Definition of Spam

For the purposes of this policy, "spam" means any unsolicited, bulk, or commercial electronic message sent without the express prior consent of the recipient. This includes but is not limited to:

• Unsolicited bulk email (UBE) — sending the same or similar message to a large number of recipients who have not opted in
• Unsolicited commercial email (UCE) — commercial messages sent without prior consent
• Phishing emails — messages designed to trick recipients into revealing personal, financial, or login information
• Malware distribution emails — messages containing or linking to viruses, ransomware, spyware, or other malicious code
• Advance-fee fraud emails (419 scams) — emails soliciting upfront payments under false pretenses
• Email spoofing — forging email headers to disguise the true sender's identity
• Email bombing — flooding a recipient or server with large volumes of email to cause disruption

2. Prohibited Email Activities

You must not use Cupisweb services — including email hosting, web hosting, or any related infrastructure — to:

• Send unsolicited bulk email to any recipient list
• Send phishing, scam, or fraudulent emails of any kind
• Harvest or collect email addresses without the explicit consent of the address owners
• Use purchased, scraped, or rented email lists without verifiable opt-in consent from each recipient
• Send emails that impersonate another person, company, or legitimate service
• Forge, alter, or falsify email headers, sender addresses, or return paths
• Operate open mail relays that allow third parties to send email through your server
• Send emails containing malware, malicious attachments, or harmful links
• Send emails that violate applicable laws, including Nigeria's Cybercrime (Prohibition, Prevention, etc.) Act 2015 and the CAN-SPAM Act (where applicable)
• Exceed Cupisweb's daily email sending limits (standard email hosting: 20 emails/day per account)

3. Permission-Based Email Standards

All email campaigns or bulk email sent through Cupisweb infrastructure must meet the following standards:

• Express consent: Each recipient must have given clear, affirmative consent to receive emails from you
• Accurate sender information: Your name and valid return email address must be clearly displayed
• Clear subject lines: Subject lines must accurately reflect the content of the email and must not be misleading
• Unsubscribe mechanism: Every commercial or marketing email must include a clear and working unsubscribe link or method
• Honour opt-outs: Unsubscribe requests must be processed within 10 business days and the recipient must not be contacted again
• Physical address: Commercial emails must include a valid physical mailing address for your business
• No deceptive content: Email content must not be deceptive, misleading, or designed to bypass spam filters

4. Email Sending Limits

To protect the reputation of our shared email infrastructure and ensure reliable delivery for all customers, Cupisweb enforces the following limits:

• Standard email hosting accounts: Maximum of 20 outbound emails per day per account
• Shared hosting accounts: Email sending limits apply per the specific hosting plan
• Reseller accounts: Resellers are responsible for enforcing sending limits on all accounts under their management

Customers who require higher sending volumes for legitimate marketing campaigns should use a dedicated transactional email service (such as Mailchimp, Brevo, or Amazon SES) rather than Cupisweb's shared hosting infrastructure.

5. Spam Monitoring & Detection

Cupisweb actively monitors outgoing email traffic for spam indicators, including:

• High bounce rates and spam complaint rates
• Sudden spikes in outbound email volume
• Emails sent to known spam trap addresses
• Blacklist notifications from services such as Spamhaus, SORBS, and MX Toolbox
• Complaints submitted to [email protected]

Cupisweb reserves the right to quarantine, delay, or block outgoing email that triggers spam detection systems without prior notice.

6. Consequences of Spam Violations

If a customer is found to be sending spam or violating this policy, Cupisweb will take the following actions depending on the severity of the violation:

• Warning: Issued for minor or first-time low-volume violations with a demand to immediately cease the activity
• Email suspension: Outbound email sending is disabled on the offending account
• Account suspension: The entire hosting or email account is suspended pending investigation
• Account termination: Permanent closure of the account with no refund for confirmed or repeat spam violations
• Blacklist reporting: The offending IP or domain may be reported to spam blacklists (Spamhaus, SORBS, etc.)
• Legal referral: In cases involving phishing, fraud, or criminal spam, we will refer the matter to the EFCC, Nigerian Police, or other relevant authorities

7. Reseller Responsibilities

Cupisweb resellers are fully responsible for ensuring their customers comply with this Anti-Spam Policy. Resellers must:

• Include equivalent anti-spam provisions in their own terms of service
• Monitor outgoing email activity on their reseller accounts
• Immediately suspend any customer account found to be sending spam
• Respond to abuse complaints involving their customers within 24 hours
• Cooperate fully with Cupisweb during spam investigations

Failure to manage resold email accounts in compliance with this policy may result in suspension or termination of the reseller account.

8. How to Report Spam

If you have received spam originating from Cupisweb infrastructure, or if you are aware of a Cupisweb customer engaging in spam activity, please report it immediately:

• Response time: All spam reports acknowledged within 12 hours
• Resolution time: Confirmed spam violations resolved within 24 hours

When reporting, please include the full email headers of the spam message, the date and time received, and any other relevant details. Full email headers are essential for us to trace the source of the message.

How to find full email headers:

• Gmail: Open the email → Click the three-dot menu → "Show original"
• Outlook: Open the email → File → Properties → look in "Internet headers"
• Apple Mail: Open the email → View → Message → All Headers

9. Legal Compliance

This Anti-Spam Policy is intended to comply with applicable laws governing electronic communications, including:

• Nigeria: Cybercrime (Prohibition, Prevention, etc.) Act 2015
• United States: CAN-SPAM Act 2003 (where applicable)
• European Union: GDPR and ePrivacy Directive (where applicable)
• United Kingdom: Privacy and Electronic Communications Regulations (PECR)

Where Cupisweb's policy is stricter than applicable law, Cupisweb's policy takes precedence.

10. Cooperation with Anti-Spam Organizations

Cupisweb actively cooperates with the following organizations to keep our infrastructure clean and our customers protected:

• Spamhaus Project
• SORBS (Spam and Open Relay Blocking System)
• MX Toolbox
• SpamCop
• Google Postmaster Tools
• Hetzner Online GmbH (our upstream provider)
• Nigerian Economic and Financial Crimes Commission (EFCC)

11. Changes to This Policy

Cupisweb reserves the right to update this Anti-Spam Policy at any time. Significant changes will be communicated via email or a notice on our website. Continued use of our services after an update constitutes acceptance of the revised policy.
